Changes to Casual Employment

The Fair Work Act 2009 (FW Act) has now been amended further to change workplace rights and obligations for casual employees. The changes came into effect on the 27th of March 2021.

Employers now have to give every new casual employee a Casual Employment Information Sheet (CEIS) before, or as soon as possible after, they start their new job.

The CEIS has information about:

  • The definition of a casual employee
  • When an employer has to offer casual conversion
  • When an employer doesn’t have to offer casual conversion
  • When a casual employee can request casual conversion
  • Casual conversion entitlements of casual employees employed by small business employers
  • The role of the Fair Work Commission to deal with disputes about casual conversion

Small business employers must give their existing casual employees a copy of the CEIS as soon as possible after the 27th of March 2021. Other employers must give their existing casual employees a copy of the CEIS as soon as possible after the 27th of September 2021.

Business owners really need to start looking at whether the changes apply to their business and to make sure they know their obligations around casuals, what constitutes a casual worker, and casual worker’s entitlements to convert to full or part time employees.
